Utility Patent

Sunday, 21 November 2010 21:35 Last Updated on Wednesday, 29 June 2011 19:40 Written by Zack

Utility Patent - $2,840 + $545 USPTO Fee = $3,395 - The utility patent is the most common patent application filed with the United States Patent and Trademark Office (USPTO).  The purpose of filing a utility patent is to protect the functionality of an invention.  It is important to remember that a utility patent protects an invention for 20 years against any sort of patent infringement.

Contrary to a design patent, a utility patent does not focus on the aesthetics of the invention.  It is more concerned with the "inner workings" of the invention and any alternate embodiments.  It may take more than two years for your application to be reviewed by an examiner and up to an additional year for the process to be completed.
